Read this document carefully and in its entirety.

By signing this agreement, you give up your right to bring a court action to recover compensation or obtain any other remedy for any personal injury or property damage however caused arising out of your participation in YMCA of Franklin and Grove City Programs, now or at any time in the future. The Undersigned agrees to the following: 1- I/we agree to adhere to all policies set forth by the YMCA of Franklin and Grove City. Acknowledgment of Risk I hereby acknowledge and agree that participation in YMCA of Franklin and Grove City activities comes with inherent risks. I have full knowledge and understanding of the inherent risks associated with YMCA participation, including but in no way limited to: (1) slips, trips, and falls, (2) aquatic injuries, (3) athletic injuries, and (4) illness, including exposure to and infection with viruses or bacteria. I further acknowledge that the preceding list is not inclusive of all possible risks associated with YMCA of Franklin and Grove City participation and that said list in no way limits the operation of this Agreement.

2- Coronavirus / COVID-19 Warning & Disclaimer Coronavirus, COVID-19 is an extremely contagious virus that spreads easily through person-to-person contact. Federal and state authorities recommend social distancing as a means to prevent the spread of the virus. COVID-19 can lead to severe illness, personal injury, permanent disability, and death. Participating in YMCA of Franklin and Grove City programs or accessing YMCA of Franklin and Grove City facilities could increase the risk of contracting COVID-19. The YMCA of Franklin and Grove City in no way warrants that COVID-19 infection will not occur through participation in YMCA programs or accessing YMCA facilities.

3- The YMCA conducts regular sex offender screenings on all members, participants, and guests. If a sex offender match occurs, the YMCA reserves the right to cancel membership, end program participation, and remove visitation access. Proper forms of identification may include a license, passport, military, student or state identification card. I agree on behalf of myself, my household, and my family with YMCA policies and procedures and understand that use of the facility can be revoked without refund for exhibiting inappropriate behavior or abuse toward YMCA staff members, members and/or facilities.

4- Code of Conduct: While on or about the YMCA of Franklin and Grove City premises, the guest must conduct themselves in an appropriate manner at all times, doing or saying nothing that could possibly endanger or disrupt the activities conducted by the YMCA of Franklin and Grove City. Fighting, swearing or instigating a situation that may prove harmful to YMCA members/participants will not be tolerated and may result in immediate removal of the premises. I, the undersigned, hereby agree to the terms of the YMCA’s guest agreement and guidelines and do further by these presents, release, remise, exonerate and forever discharge and save harmless the YMCAs of Franklin and Grove City, its employees, officers, and directors from and against any and all liability whatsoever on account of my use of the YMCA facility, grounds and apparatus.

5- Waiver, Release, Indemnification & Covenant Not to Sue In consideration of my participation in YMCA of Franklin and Grove City: I, the undersigned participant, agree to release and on behalf of myself, my household, and my family, my heirs, representatives, executors, administrators, and assigns, HEREBY DO RELEASE the YMCA of Franklin and Grove City, National Council of Young Men’s Christian Associations of the United States of America, and its independent and autonomous member associations in the United States and Puerto Rico, their officers, directors, employees, volunteers, agents, representatives and insurers (“Releasees”) from any causes of action, claims, or demands of any nature whatsoever including, but in no way limited to, claims of negligence, which I, my heirs, household and family, representatives, executors, administrators and assigns may have, now or in the future, against any Releasees on account of personal injury, property damage, death or accident of any kind, arising out of or in any way related to the use of YMCA of Franklin and Grove City facilities/equipment or participation in YMCA of Franklin and Grove City programs whether that participation is supervised or unsupervised, however the injury or damage occurs, including, but not limited to the negligence of Releasees. In consideration of my participation in YMCA of Franklin and Grove City, I, the undersigned participant, agree to INDEMNIFY AND HOLD HARMLESS Releasees from any and all causes of action, claims, demands, losses, or costs of any nature whatsoever arising out of or in any way related to my YMCA of Franklin and Grove City participation. I hereby certify that I have full knowledge of the nature and extent of the risks inherent in YMCA of Franklin and Grove City participation and that I am voluntarily assuming said risks. I understand that I will be solely responsible for any loss or damage, including personal injury, property damage, or death, I sustain while participating in YMCA of Franklin and Grove City and that by signing this agreement I HEREBY RELEASE Releasees from all liability for such loss, damage, or death. I further certify that I am in good health and that I have no conditions or impairments which would preclude my safe participation in YMCA of Franklin and Grove City. I further certify that I am 18 years or older and that I am therefore of lawful age and otherwise legally competent to sign this agreement. I further understand that the terms of this agreement are legally binding and certify that I am signing this agreement, after having carefully read it, of my own free will.
